Section 8
No land use changes;
(1) In accordance with section 4, land classified for one purpose cannot be changed to use it for another purpose.
(2) Notwithstanding anything written in sub-section (1), if any person has to use the land under his right for a purpose other than the prescribed purpose, he shall submit an application to the relevant local land use council to reveal the basis and reason thereof.
(3) If an application is received according to sub-section (2) or if there is a need to change the prescribed land use of any land within its area, the concerned local land use council shall request the provincial land use council to disclose the basis and reason thereof.
(4) If a request is received in accordance with sub-section (3), the Provincial Land Use Council shall study and submit a technical report for that purpose, experts in the fields of soil, geology, law, land use planning, agriculture, forestry and environment, land, land surveying and urban planning and relevant local level experts. A committee headed by the chief or deputy chief may be formed.
(5) Based on the technical report provided by the committee as per sub-section (4), if it is deemed appropriate to change the land use according to the demand, the Provincial Land Use Council shall make a recommendation to the Federal Land Use Council. (6) If a recommendation is received in accordance with sub-section (5), the Federal Land Use Council may change the existing land use.
(7) Notwithstanding anything contained in sub-section (1), the Government of Nepal may change the existing land use of the following places:-
(a) the surface or sub-surface of the earth containing important natural resources in the solid, liquid or: gas state,
(B) Places to establish projects of national pride or priority development projects, industrial zones, special economic zones, etc. (c) Areas of importance from the point of view of national security, international borders, places of cultural, natural, historical and archaeological importance included in the World Heritage List,
(d) The place where interprovincial land use area should be managed,
(e) Government of Nepal requiredOther areas considered appropriate.
(5) Notwithstanding anything written elsewhere in this section, the provincial government may, on the recommendation of the concerned local land use council, change the existing land use in the following cases:- (a) Inter-local level land use: In case of area management,
(b) If any state-level development project in the geographical area of two or more local levels has to be conducted.
(9) Other provisions related to the process of giving approval for land use change shall be as prescribed.
